Affiliate Terms

Introduction

Until Lubbih is formally incorporated, these documents are provided by the operators of the Lubbih platform ("Lubbih," "we," "us," or "our"). Your agreement is with those operators, reachable at the contact details below. When a registered company becomes the operator of Lubbih, these pages will be updated to name that entity.

These Affiliate Terms apply to anyone who joins Lubbih’s creator / influencer affiliate program (“you,” “Creator”). They supplement our Terms of Use and Privacy Policy. By signing up as a Creator, generating referral links, or accepting commissions, you agree to these Affiliate Terms.

1. Independent contractor

You are an independent contractor, not an employee, partner, or agent of Lubbih for employment or tax purposes, except as required to pay commissions under this program. You control how you create content, subject to these rules and applicable law. Nothing here creates a joint venture or franchise.

2. Commission structure

Commissions are calculated as a percentage of Lubbih’s net platform profit on qualifying attributed sales — that is, platform markup after applicable processor fees, as defined in our published deal economics — not a percentage of the merchant’s payout or of total customer payment.

Current published model (subject to change prospectively): creator share starts at 30% of net platform profit on the first attributed completed sale and may increase by 1% per prior attributed completed sale for that Creator, capped at 40%. Specific rates shown in your creator dashboard control for a given sale when displayed.

Qualifying sales generally mean paid vouchers in good standing (pending or redeemed as defined in our systems) attributed to your referral under our attribution rules. Canceled, refunded, charged-back, or fraudulent transactions do not qualify or may reverse prior accruals.

3. Attribution

We typically attribute a visit via your unique referral link using a cookie or similar technology for a limited window (commonly seven days). Last click / last qualifying referral rules may apply as implemented in our systems. We are the sole judge of attribution for technical and anti-fraud reasons.

Self-referral (buying through your own link to earn commission), artificial inflation, cookie stuffing, incentivizing purchases solely for commission fraud, or using bots is prohibited and voids commissions.

4. Vesting, holds, and payouts

Commissions may be held for a period after redemption (for example seven days) before becoming eligible for withdrawal, as shown in your dashboard or Help materials.

Government-issued ID (or other verification we reasonably require) must be completed before your first withdrawal. You are responsible for providing accurate payout details.

Payout timing, minimums, and methods may change; we will reflect current rules in-product or by notice.

5. No earnings guarantee

We do not guarantee any level of traffic, conversions, or commissions. Rates, attribution windows, and program rules may change for future sales. Past performance is not a promise of future results.

6. Conduct and brand use

• Do not spam; do not use misleading claims about deals, discounts, or Lubbih
• Do not bid on Lubbih trademarks or confusingly similar terms in paid search without written permission
• Do not impersonate Lubbih or merchants
• Promote only in lawful channels and audiences 18+ where purchases are involved
• Use Lubbih logos and materials only as we approve; we may revoke brand permissions at any time
• Comply with advertising disclosure laws (clearly disclose sponsored / affiliate relationships where required)

7. Taxes

You are solely responsible for taxes on amounts we pay you. Where required by law, we may withhold amounts or collect tax information. Jamaica tax rules and any other applicable jurisdiction may apply to you.

8. Termination and clawbacks

Either party may end your participation at any time, with or without cause, by notice (including disabling your account).

Upon termination for fraud, breach, or abuse, unpaid or unvested commissions may be forfeited. We may claw back commissions already paid that were tied to fraud, chargebacks, or clear breach, to the extent permitted by law.

Sections that by nature should survive (including liability limits, tax, confidentiality of non-public rates/data, and clawbacks) survive termination.

9. Intellectual property

Lubbih retains all rights in the Lubbih brand, site, and materials. You retain rights in your own original content, and grant Lubbih a non-exclusive license to reference your public promotions of Lubbih for marketing of the affiliation (e.g., “as featured by”), unless you revoke that in writing for future use.

10. Liability

To the fullest extent permitted by law, Lubbih’s total liability under these Affiliate Terms is limited to commissions actually owed and unpaid to you for the ninety (90) days preceding the claim. We are not liable for lost profits, indirect, or consequential damages arising from the affiliate program.

11. Changes

We may update these Affiliate Terms by posting a new version. Continued participation after the effective date constitutes acceptance for future activity. Changes generally apply prospectively to new attributions and payouts.

12. Governing law

These Affiliate Terms are governed by the laws of Jamaica. Exclusive jurisdiction lies with Jamaican courts, subject to non-waivable mandatory protections.
